VicWater Workshop Series : New Victorian Workplace Manslaughter Legislation

About this Event

From 1 July 2020 new provisions will apply to create the statutory offence of workplace manslaughter, inserted into the Occupational Health and Safety Act 2004 (Vic) (OHS Act). Employers, Officers (executives and Board members) and employees can be guilty of the offence. Individuals could face up to 20 years imprisonment while Body Corporates could be fined up to $16.5m (a tenfold increase on current penalties).

The introduction of the new legislation in Victoria represents a new era in workplace safety enforcement. This information session will help Victorian water corporation boards and executive to understand the new provisions and assess (or reassess) their critical safety risks to ensure that they are meeting their duties.

About the Speaker

Catherine Dunlop, Partner

Catherine is one of Australia’s leading lawyers in the areas of WH&S (Work Health & Safety). She leads the Maddocks safety practice and advises on all aspects of safety including procurement and contractor management, WHS systems, asbestos, due diligence and responding to prosecutions. With her extensive experience in providing incident response advice, Catherine assists clients in dealing with police and other investigative authorities, and working with media and reputation advisors.

Catherine has extensive experience in coronial inquiries and government inquries. She has acted in three Royal Commissions in Victoria, and two national Royal Commissions including acting for the CFA in the Victorian Bushfire Royal Commission from the morning after Black Saturday, and acting for the Secretary of a Commonwealth Department in the Home Insulation Royal Commission. She has represented public sector clients in significant coronial inquests, Ombudsman’s inquiries and in parliamentary inquiries.

Catherine has a background and broad knowledge of administrative law and statutory interpretation, and brings this to her work for government clients and related bodies to assist them with issues such as regulatory reform and judicial review. Catherine is also renowned as a trainer and regularly provides practical workshops and seminars for government clients.
